			<content:encoded><![CDATA[<p>The Board of Directors of the Fountaingrove Ranch Master Association is starting  the process of reviewing  the original CC&#038;Rs, first recorded on October 22, 1985, as the Master Declaration of Covenants, Conditions and Restrictions of Fountaingrove Ranch.  There have been no revisions to the CC&#038;Rs since that date. <span id="more-181"></span></p>
<p>Earlier this year, the Board became aware that there are separate CC&#038;Rs for SUBDIVISIONS such as “Southridge Declaration of Covenants, Conditions and Restrictions”.  These “post-facto” documents were created after the Master CC&#038;Rs were created and recorded.  Since these subdivisions did not create a separate homeowners’ association and never amended their CC&#038;Rs, the Board lacks the authority to enforce these separate CC&#038;Rs except as they coincide with the CC&#038;Rs of Fountaingrove Ranch. </p>
<p>In addition, new federal and state laws that have been passed affect the FRMA CC&#038;Rs.  From time to time over the past 24 years, residents who belong to the Master Association have expressed concerns about excessive parking, noise, animal control, garbage cans, boats and trailers and how the FRMA CC&#038;Rs can be enforced.</p>
<p>The Board anticipates that this review process required by California law could take as long as a year and will require community meetings of the members to produce a final product.  We want to include all of our membership in the review process and get it right.</p>
<p>The Restated CC&#038;Rs is color coded for easy reading.  Please use the following information to assist you in reviewing this important document.</p>
<p><strong><em>The blue text is substantially the same as in their current documents with the developer specific provisions removed and some language revised for easier reading and clearer communications.</p>
<p>The red text are sections drafted to reflect and comply with Davis-Stirling Common Interest Development Act, Corporations Code, and California case law.  There are a few items that can be modified (such as the Association can change the due date of assessments and date they are late, choose a lower interest rate on delinquent accounts, etc.) but most have very little flexibility.</p>
<p>The black text is what the Board of Directors is recommending to be added.</em></strong></p>
<p>All owners and members are strongly urged to please read and provide comments on the CCRs as soon as possible by email to frmaccrs@att.net.</p>

<p><strong>1. Do I need a permit to pour a concrete pad on my property?</strong><br />
Yes. All &#8220;hardscape&#8221; improvements require an application. Hardscape includes walkways, patios, pads, rock walls etc. The ACC encourages property improvements but wants to help you comply with our CC&amp;Rs as you proceed. Therefore, we ask you to submit your plans. You may prepare simple drawings and you may appear in person at an ACC meeting to present your plan. In most cases, we&#8217;ll approve. In some cases we&#8217;ll ask a professional consultant to evaluate the plan and report compliance with the CC&amp;R&#8217;s.<span id="more-60"></span></p>
<p><strong>2. Do I need a permit to renovate the plants and flowers in my front and rear yards? </strong><br />
Generally, no. Replacement of dead or inappropriate plants does not require a permit. However, major renovations that include removal of trees that pre-existed original construction do require a plan and application.</p>
<p><strong>3. I&#8217;m surprised to learn that re-painting my home necessitates an application. Why is this?</strong><br />
The ACC wishes merely to assure that house colors remain consistent with our CC&amp;R&#8217;s.</p>
<p><strong>4. </strong><strong>Is a permit needed to build a crushed gravel walkway in my garden? </strong></p>
<p>Yes. Crushed gravel is hardscape. The ACC wants to see your plan to make certain that it complies with the CC&amp;R&#8217;s. Again, refer to the Design Review Manual</p>
<p><strong>5. We wish to add a satellite dish or two to the exterior of our home. Do we need to apply for permission? </strong><br />
Generally, no. Exceptions would include a location for the antennae that interferes with a neighbor. After you&#8217;ve had the satellite dish company survey for appropriate locations, we suggest you talk with neighbors if there is any chance for objection.</p>
<p><strong>6. I want to add a prefabricated Gazebo to my yard, amidst the oaks and bay laurels on my hillside. Do I need a permit? </strong><br />
Yes. Such additions usually require hardscape for the foundation and access path. Further, there are CC&amp;R requirements regarding external structures and the protection of native trees on hillsides, be they private or public land. It&#8217;s pretty complex. By looking at your plans, the ACC and our consultants can help assure conformance to all requirements.</p>
<p><strong>7. When I think I need a permit, do I start at the City (of Santa Rosa) planning department or at the ACC?</strong><br />
Yes. Always start at the ACC.</p>

Some of our irrigation systems are older with sprinkler head that are less than efficient.  This effort is beyond the normal replacement of parts that wear out.  The City has a program the Association intends to take advantage of that would help pay for the replacement and upgrades.  While we have improved numerous landscape areas, this work is continuing.  Our goal is to save both water and money.</p>

November 14, 2007</p>
<p>This report is intended as both a plan and guide for the annual mitigation of wildland fire fuels in both the open space areas within the FRMA and adjacent properties.</p>
<p>Because of the proximity of the FRMA to vast areas of wildland, as well as areas of FRMA open space which contain significant amounts of vegetation and are adjacent to homes, it is incumbent upon the FRMA to remain vigilant as to the condition of these areas and take appropriate steps to ensure that they are maintained in a fashion which meets fire safety requirements.  Failure to do so could result in individual and/or collective liability, for FRMA board members, the association and the property manager, which could be either criminal and/or civil in nature.</p>
<p>Therefore, the attached report should be reviewed at least annually and updated as necessary to comply with changing conditions, regulations and laws.  The Property Manager should be instructed to take the necessary steps to ensure that all FRMA opens space areas and properties adjacent to the FRMA comply with current regulations, including consulting with the Santa Rosa Fire Department, California Department of Forestry and Fire Protection, County Fire Services and contractors, as needed.  This report provides all of the information necessary to accomplish the above tasks.</p>

<p>Anyone witnessing dumping is encouraged to get vehicle descriptions and license plate numbers. This information should be reported to the police.</p>
<p><span id="more-20"></span>Homeowners should clearly instruct their landscape maintainers (the mow-blow-go guys) that yard waste must not be dumped. It creates a fire hazard. Members pay for the problem when FRMA authorizes cleanup expenses.</p>
<p>Yard waste should be placed in the large brown container provided to  homeowners, and this may be placed at the curbside every week. For larger quantities, the waste should be hauled to an appropriate facility, such as the county land fill or to green recyclers like &#8220;Grab &amp; Grow,&#8221; 2759 Llano Rd., Santa Rosa (707-575-7275).</p>

Please refer this question to your CPA or Tax Attorney. The FRMA cannot offer legal or tax advice.</p>
<p><strong>6. What happens if dues are not paid?</strong><br />
The FRMA board takes steps to maintain each dues account in good standing. For a dues account that is seriously in arrears, where the homeowner is not responsive, the FRMA adheres to the delinquent and collection policy. Your account will be turned over to a collection agency that the Association has currently contracted with. ========</p>
